Affiliate Terms and Conditions

Everything you need to know about working with us as an affiliate partner.

Terms & Conditions

These Terms & Conditions (“Agreement”) govern your participation in the Medthera Affiliate Program (“Program”) and your use of affiliate links directing users to www.walkport.com.

Throughout this Agreement, “Medthera,” “we,” “us,” and “our” refer to Medthera, Inc., and “you” or “Affiliate” refers to the participating party.

By applying to and participating in the Program, you confirm that you have read, understand, and agree to be bound by this Agreement, and that you are legally able to enter into binding contracts.

Failure to comply with these terms, misuse of the Medthera brand, or participation in prohibited activities may result in withheld commissions, reduced payments, or termination from the Program.

Enrollment Process

To participate, you must submit a complete application through the WalkPort website. Medthera reserves the right to accept or reject any application at its sole discretion.

We may reject or terminate participation if your site:

  • Is deemed unsuitable
  • Engages in prohibited activities
  • No longer aligns with Program standards

Acceptance criteria may change at any time without notice.

Commissions
  • Affiliates earn 3% commission on net sales for products sold and shipped in the US when your link is used.
  • Net sales exclude taxes, shipping, handling, returns, and refunds.
  • A commission is earned only when:
    • A user clicks your affiliate link, and
    • Completes a purchase within 30 days.
  • Affiliates are responsible for proper link setup and tracking.
Payment
  • Commissions are calculated monthly based on prior month net sales.
  • Payments are issued via PayPal on the 15th of the following month.
  • Returns, refunds, and chargebacks will be deducted from commissions.
Tax Compliance

If an Affiliate earns $600 or more within a 12-month period, Medthera may withhold payment until a valid W-9 form is submitted and approved.

Returns/Refunds

If a customer returns a product for a refund, or if credit card charges are reversed due to a dispute or credit card fraud, your account will be debited for any commission earned on that transaction.

Affiliate Responsibilities

You agree to:

  • Provide accurate and up-to-date account, payment, and tax information
  • Disclose all websites and channels used to promote Medthera
  • Comply with all applicable laws and regulations

Failure to provide accurate information may result in suspension, termination, or forfeiture of commissions.

Website Obligations

You are solely responsible for:

  • Your website’s operation, maintenance, and content
  • Ensuring all materials are accurate, lawful, and appropriate
  • Properly representing Medthera and its products
Prohibited Content & Unsuitable Sites

Medthera may reject or terminate Affiliates whose sites include or promote:

  • Explicit, obscene, or violent content
  • Hate speech or discrimination
  • Illegal activities
  • Tobacco, alcohol, or gambling promotion
  • Misleading claims or impersonation of Medthera
  • Intellectual property violations
  • Malware, spyware, or harmful code
  • Traffic diversion or commission hijacking tactics

Additional disqualifiers include:

  • Lack of a privacy policy
  • Restricted-access sites (login required)
  • Non-U.S.-focused websites
  • Use of “Medthera” or “WalkPort” in domain names

Medthera retains sole discretion in determining suitability.

Advertising Channel & Promotion Restrictions

Affiliate may promote Medthera and WalkPort only through approved channels and in strict compliance with this Agreement and all applicable laws. Any promotional activity not expressly permitted herein is prohibited unless Medthera provides prior written authorization.

Prohibited Advertising Methods

Unless expressly approved in writing by Medthera, Affiliate shall not:

  • Purchase or bid on paid search keywords, ad groups, or phrases that include or are confusingly similar to “Medthera,” “WalkPort,” or variations or misspellings thereof;
  • Use Medthera or WalkPort trademarks, brand names, logos, or product images in paid search, display, native, or social media advertisements;
  • Engage in brand bidding, competitive conquesting, or keyword hijacking;
  • Run paid social advertisements (including but not limited to Facebook, Instagram, TikTok, YouTube, or LinkedIn ads);
  • Use retargeting, behavioral advertising, lead‑generation ads, or lookalike audiences;
  • Create ads that redirect traffic through intermediate pages, cloaked URLs, or masked tracking links;
  • Use pop‑ups, pop‑unders, browser extensions, toolbars, or forced redirects;
  • Distribute promotions via unsolicited email, text messaging, robocalls, or spam in violation of CAN‑SPAM, TCPA, or similar laws.

Approved Promotional Channels

Subject to compliance with this Agreement, Affiliates may promote Medthera only through the following channels:

  • Organic website content, blogs, and review pages;
  • Organic social media posts using compliant FTC disclosures;
  • Email newsletters to subscribers who have affirmatively opted in, provided such communications comply with CAN‑SPAM and applicable privacy laws.

Content & Branding Restrictions

Affiliate may not:

  • Impersonate Medthera, WalkPort, or Medthera employees or representatives;
  • Register or use domain names, social media handles, or profiles containing Medthera, WalkPort, or confusingly similar variations;
  • Copy or mimic the “look and feel” of Medthera’s website, marketing materials, or branding;
  • Use unauthorized coupons, promotional codes, rebates, or pricing claims.

All marketing content must be truthful, non‑misleading, and consistent with Medthera‑approved messaging.

Right to Audit and Enforce

Medthera reserves the right, but not the obligation, to:

  • Audit Affiliate promotional activities and advertising placements;
  • Require immediate modification or removal of non‑compliant marketing materials;
  • Suspend or terminate Affiliate participation for violations of this section;
  • Withhold, reduce, or claw back commissions resulting from prohibited advertising activities.

Violation of this section constitutes a material breach of this Agreement and may result in immediate termination without notice.

Healthcare, Medical Claims & Regulatory Compliance

Affiliate agrees to comply with all applicable healthcare laws and regulations, including but not limited to requirements of the FDA and FTC.

Affiliate may only use marketing language, product descriptions, and claims that have been expressly approved by Medthera. Affiliate shall not:

  • Make any medical, therapeutic, or clinical claims that are not specifically authorized by Medthera
  • Represent the product as “FDA approved” unless explicitly permitted in writing
  • Suggest guaranteed outcomes or cures
  • Provide medical advice or represent themselves as a healthcare provider (unless properly licensed and disclosed)
  • Modify, exaggerate, or misinterpret product capabilities or intended use

Affiliate acknowledges that Medthera’s products are subject to regulatory oversight and agrees to ensure that all promotional content is accurate, balanced, and not misleading.

Medthera reserves the right to:

  • Review and approve affiliate content
  • Require removal or correction of non-compliant claims
  • Immediately terminate participation and withhold commissions for violations
Medthera Responsibilities

Medthera will:

  • Provide affiliate links and promotional materials
  • Process all orders, payments, and customer service
  • Track qualifying purchases and report performance
Tracking & Cookies
  • Affiliate tracking is managed via browser cookies valid for 30 days
  • The most recent affiliate click overrides previous cookies

Medthera is not responsible for lost tracking due to user actions (e.g., cookie deletion)

Term and Termination
  • Either party may terminate this Agreement at any time, with or without notice
  • Upon termination:
    • Affiliates must remove all Medthera promotions immediately
    • Final commissions will be paid on the next payment cycle
International Users

This website is accessible worldwide.  The site is controlled, operated, and administered by Medthera from its offices within the State of Minnesota, United States of America.  If you access the site from a location outside the United States, you are responsible for compliance with all local laws.  You agree that you will not use Medthera’s content accessed through the site in any county or in any manner prohibited by any applicable laws, restrictions or regulations.

Non-Exclusivity

This Agreement does not create an exclusive relationship. Both parties may engage in similar partnerships.

Confidentiality

You agree to keep confidential any non-public information related to Medthera, including:

  • Business operations
  • Pricing and sales data
  • Customer information

Disclosure is only permitted:

  • With written consent
  • To professional advisors under confidentiality
  • As required by law (with prior notice to Medthera when possible)
Independent Evaluation

You acknowledge that:

  • You have independently evaluated participation in the Program
  • Medthera may operate competing programs or solicit customers independently
Indemnity

You agree to indemnify, defend and hold harmless Medthera, its officers, employees, directors, vendors, licensors, or contract employees (“Indemnified Parties”) against all claims, damages, losses, obligations, liabilities, costs and expenses  that arise from (i) any claim that our use of the Affiliate Trademarks infringes on any trademark, trade name, service mark, copyright, license, intellectual property, or other proprietary right of any third party (ii) any misrepresentation of a representation of warranty or breach of a covenant and agreement made by your herein, (iii) any claim related to your site, including, without limitation, its development, operation, maintenance and content therein not attributable to us or (iv) Affiliate engaging in any prohibited activity.

Governing Law

Any controversy, claim or dispute arising under this Affiliate Agreement will be governed by the laws of the State of Minnesota and the applicable federal laws of the United States of America.  All disputes arising under, or in any way connected with the Affiliate Program shall be litigated exclusively in the state and federal courts residing in Carver County, Minnesota and in no other court or jurisdiction.

Modification of these Terms and Conditions

Medthera reserves the right to modify these Terms at any time, including:

  • Commission structure
  • Payment processes
  • Program rules

Continued participation constitutes acceptance of updates.

Force Majeure

You acknowledge that Medthera’s and the network’s services, equipment, and services (e.g. tracking and reporting) may be subject to temporary modifications or shutdowns due to causes beyond Medthera’s and the network’s reasonable control.  Such temporary service interruptions will not constitute a material breach of this Agreement.

Medthera is not responsible for the content or reliability of third-party websites linked through our platform. Use them at your own risk.

FTC Disclosure & Endorsement Compliance

Affiliate agrees to comply with all applicable laws and regulations, including the Federal Trade Commission (FTC) Guides Concerning the Use of Endorsements and Testimonials in Advertising.

Affiliate must clearly and conspicuously disclose their material relationship with Medthera in any promotional content, including but not limited to websites, social media posts, emails, videos, and advertisements.

Disclosures must:

  • Be placed in close proximity to any endorsement or affiliate link
  • Be easily noticeable and understandable to the average consumer
  • Not be hidden, minimized, or obscured by design or placement

Acceptable disclosure examples include:

  • “I may earn a commission from purchases made through this link.”
  • “This post contains affiliate links.”

Affiliate agrees not to make any false, misleading, or unsubstantiated claims regarding Medthera products, including medical, therapeutic, or performance-related claims that are not expressly approved by Medthera.

Medthera reserves the right to:

  • Review Affiliate promotional content for compliance
  • Require modifications or removal of non-compliant content
  • Withhold commissions or terminate participation for violation
Disclaimers

Medthera makes no express or implied warranties or representations with respect to the Affiliate Program, the Medthera site, the link or any Medthera products sold through the Affiliate Program (including, without limitation, WARRANTIES OF FITNESS, MERCHANTABILITY, NON-INFRINGEMENT, OR ANY IMPLIED WARRANTIES ARISING OUT OF COURSE OF PERFORMANCE, DEALING, OR TRADE USAGE).  In addition, we make no representation that the operation of the Medthera site will be uninterrupted or error free, and we will not be liable for the consequences of any interruptions or errors, including the tracking of information about referred users during the period of interruption.  YOU USE OUR SITE, THE PROGRAM, THE LINK (INCLUDING ANY WIDGETS) AND OUR SERVICES AT YOUR SOLE RISK AND AT YOUR OWN FREE WILL.  ALL MATERIALS ON THE WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED. Kevin shares his inspiring full testimony at WalkPort.

We had the privilege of trying out Medthera’s new WalkPort machine for 30 days. First look at this product had me amazed at how compact it is, while adding more natural leg action into the design that can easily be adapted from a 6-foot patient to my 5-foot 2-inch wife. My wife, LuAnne, has been in physical therapy for 36 months. In that time, we have used 3 different styles of machines, most of which required one or two therapists to get her into. One took over 20 minutes to go from wheelchair to harness to the machine. Once in, one of the therapists would control the speed while the other would make sure LuAnne was OK and, in some cases, moving her leg. WalkPort does a fantastic job of addressing all the problems I have seen in the current style of machines on the market today.

The 3 area’s that I feel make it stand out.

1. The design is so easy to adjust to fit the patient. Once set up, the patient can do as much of the transfer from the wheelchair to the WalkPort as their disability will allow. In our case, LuAnne can roll up to the machine and get into the seat on her own. We have to position her right leg, which is paralyzed, into position and secure her foot. Once that is done, she can get herself to a standing position and start the motion of walking with no assistance from us. This allows her to walk for around a half hour quite easily.

2. The motion of the legs, knee and ankle is so close to actual walking movement, helping her re-establish the motor function of walking in her brain. The muscle gain and stamina were rather noticeable every day with major improvements over the course of our time with WalkPort. Towards the end of our 30 days, we had to limit LuAnne to an hour in the evening sessions as she was enjoying it so much.

3. The last and probably most valuable aspect is the attitude/excitement LuAnne expressed. She was incredibly proud of the work she was doing, especially how much of it she could perform unassisted. She always had a bright smile on her face when using the machine. She had gained such a boost in confidence while doing her exercises, from maneuvering around the machine on her own, to holding a standing position, to starting the motion of walking without assistance. She was very empowered seeing how much progress she was making on her own.

The size of this machine is about one-third the size of the other machines we had tried in the past. The first day we were introduced to the machine, LuAnne was in it and walking on her own within minutes. No motors controlling her stride. The enjoyment we saw on her face was so nice to see. Something else my daughter noticed was LuAnne walking forward for a while, then stopping and starting to walk backwards. I am not a therapist, but this seems to be a big deal to me.

In the end, LuAnne was able to gain muscle in her right leg and increase her stamina. We are still working on her walking on her own, but I am sure using this machine will reduce the time it will take to get to the next level of recovery.
